General Terms and Conditions
General Terms and Conditions for the online shop AlpineBerryTale.com (hereinafter also referred to as online shop) are prepared in accordance with the applicable Slovenian consumer protection legislation. They are intended to provide clear information about the operation of our online shop, the rights and obligations of the provider and the customers, and regulate the mutual relationship between the provider and the user.
By making any purchase in the online shop, the Customer acknowledges that he/she has read and agrees to these General Terms and Conditions. In case of any questions regarding the terms and conditions or the operation of the online shop, the buyer may contact us using the contact details provided.
Provider and contact details
AlpineBerryTale.com is operated by Luka Novak s.p. (hereinafter referred to as Provider). The tenderer is a registered sole trader, which sells food products - wild strawberries in various forms (freeze-dried strawberries, chocolate-covered strawberries, strawberry powder and granola with strawberries).

Accessibility of information
The Supplier undertakes to provide the Buyer at all times with all information required by lawincluding: the identity of the company (name, registered office and any registration number), contact details for rapid communication (e-mail, telephone), the essential characteristics of the products, the prices clearly and unambiguously set out (including VAT and delivery charges, unless explicitly stated otherwise), delivery information (method, place and date of delivery), payment and delivery information, information on any additional charges (e.g. information on any delivery charges or cash on delivery fees, if any), an explanation of the complaints and withdrawal procedure, and contact details for resolution. All this information is available to the Buyer in these General Terms and Conditions or in other relevant places on the Website.
Product range and prices
The product range in the online shop is regularly updated. All products displayed on the site are usually in stockunless otherwise indicated on the product. In the exceptional event that the product ordered is out of stock or cannot be dispatched within the promised time, the supplier will immediately inform the customer and offer the possibility to open the order, replace the product or otherwise resolve the situation.
Prices of all products are indicated in EUR (EUR). Unless explicitly stated otherwise, prices already include value added tax (VAT) at the applicable rate. Delivery charges not included in the price of the product and charged separately at the time of order completion, unless a special offer or the value of the order allows free delivery (such information will be clearly indicated).
Despite our commitment to keeping up-to-date, it is possible that a price may be incorrect or that price information may change during the processing of an order. In such a case, or in the event of an apparent pricing error, the supplier will allow the customer to withdraw from the purchase or offer a mutually satisfactory solution. The Supplier reserves the right to change prices without prior notice. Any price change will be effective from the time of publication and will not affect orders already confirmed (i.e. orders placed before the price change will be subject to the prices in force at the time the order was placed).
Payment methods
Available to customers the following payment methods for purchases in our online shop:
Pay by credit or debit card: We accept payment cards from the relevant providers (e.g. Visa, MasterCard, Maestro, etc.). You pay with your card when you place your order via a secure payment system. Once the card details have been submitted, the transaction will only take place when the goods are dispatched. Card payments are additionally protected by security mechanisms (e.g. 3-D Secure), and for security reasons the provider does not store customer card data.
Payment by invoice (bank transfer): You will receive an invoice with all the payment details (amount, supplier's account, reference, purpose of payment) to your email address after you have placed your order. The validity period of the invoice is 3 working days. Once your payment has been received on our TRR, the order will be dispatched within the estimated time. If we do not receive payment within this time limit, we will consider that you have withdrawn from the order.
Cash on delivery (cash on delivery): You can pay in cash to the delivery driver upon receipt of your order. For cash on delivery, the delivery service (Post Slovenije or GLS) may charge a small fee for the payment of the ransom, which you will be informed about during the order process. Please have as accurate a sum as possible ready at the time of collection to speed up collection. Remark: For orders with delivery outside Slovenia, cash on delivery is usually not available, so we recommend payment by card or pre-invoice for foreign customers.
All payments must be settled within EUR (EUR). Once payment has been received (or, if cash on delivery is chosen, when the order is placed), the supplier will process the order and proceed with dispatch.
Delivery and collection
The supplier shall ensure delivery of the products ordered in the area the whole of SloveniaWe also offer delivery abroad (EU and non-EU countries). We trust the delivery of parcels Post Slovenije or courier service GLSreliable partners who make sure your shipment reaches you quickly and safely.
Delivery costs: The shipping charge will be calculated according to the delivery service's current price list and will be clearly indicated at the time of order completion, before you confirm your purchase. For orders above a certain value, the supplier may offer free shipping - such promotion will be announced prominently in the online shop (e.g. a banner stating "Free shipping over XX €"). The cost of shipping abroad is higher and will also be displayed at the time of order placement, depending on the country of delivery.
Delivery date: We will do our best to dispatch the products within 1-3 working days from order confirmation or receipt of payment (if you pay by invoice, the time limit runs from receipt of the transfer). The usual delivery time for addresses in Slovenia is then 1-3 working days from dispatch. For addresses in other EU countries, the delivery time varies depending on the country (usually 3-7 working days). Please note that delivery does not take place during weekends and public holidays, so the delivery time will be extended accordingly. If the delivery time is extended for unforeseen reasons (e.g. unforeseen delays by the delivery service or force majeure), we will inform you.
Delivery address: When placing an order, customers are obliged to provide a correct and complete address where they wish to receive the shipment. To avoid delays, please make sure that you have also provided the correct postcode and contact telephone number (the delivery agent can call you if there are any problems with the delivery).
Receiving your shipment: Please inspect the parcel carefully upon delivery. If the parcel is physically damaged, shows signs of opening or is missing contents, notify inform the supplier immediately and together draw up a record of the injury/deficiency. All packages sent by post or courier are sent with a tracking number so you can track their status. If the parcel is not delivered within the expected time, please contact us to check the status with the delivery service.
The Supplier reserves the right to choose another delivery service if this will result in a more efficient fulfilment of the order. In any case, the delivery conditions (cost, time) will be comparable to the above descriptions.
Purchase procedure
Buying at AlpineBerryTale.com is easy:
Choice of products: On the website, select the products you want and add them to your basket by clicking on the "Add to basket". In the shopping basket, you can review the list of selected products, change quantities or remove products before placing your order.
Data entry: When you have finished selecting your products, proceed to the checkout. Enter the required information in the checkout form: first name, last name, delivery address, contact phone number, email address and select your preferred payment and delivery method. If you want a bill to your company or delivery to another address (e.g. as a gift), you will be able to tick the appropriate boxes.
Order overview: Before placing your order, please check that the information you have entered and the contents of your basket (products, quantities, prices) are correct. The system will also calculate the total amount, including delivery costs and any discounts.
Placing an order: By confirming the General Terms and Conditions and clicking on the "Confirm order", you will be obliged to pay for the products you have selected. Depending on the payment method you have chosen, the system may redirect you to a secure payment page (e.g. in the case of payment by card or online bank). After successful order placement, you will receive an email confirmation of receipt of your order.
Order confirmation and dispatch: The supplier will review the order, check the stock and send a confirmation email to the customer (the order status will be updated to "Certified"). From that moment, the contract of sale is concluded between the buyer and the offerer. The Bidder will then prepare the package and dispatch it within the specified time limit. You will be notified of the dispatch by e-mail (you may also receive a tracking number).
The provider tries to make the ordering process as transparent and user-friendly as possible. If you have any problems placing your order or if you are unsure whether your order has been placed successfully, please contact us and we will help you.
Right of withdrawal and return of goods
As a consumer, you have the right to 14 days after receipt of the goods inform the provider in writing (by email or physical address) that you withdraw from the contract, without having to give a reason for your decision. The withdrawal period starts the day after the date of collection of the products. In order to exercise your right of withdrawal, it is sufficient for you to notify us of your withdrawal (e.g. by sending an unequivocal statement to our e-mail address) within the stated withdrawal period. The only direct costcharged to the consumer at the time of withdrawal is the cost of returning the goods by post.
In the event of withdrawal from the contract, the consumer must return it within 14 days at the latest from the date on which the notice of withdrawal was given. Goods must be returned undamaged, in the same quantity and in the original packagingunless the goods have been destroyed, spoiled, lost or reduced in quantity without any fault on the part of the consumer. The invoice or a copy of the invoice must also be attached. Return should be made to the supplier's address (as stated above). We recommend that you pack the goods properly so that they are not damaged in transit.
Once we have received the returned goods and verified that they are in the correct condition, we will without delay, and at the latest within 14 days repay all payments made from the date of receipt of the cancellation notice. We will refund payments using the same means of payment used by you (unless you expressly request another means of payment and no costs are incurred as a result). The supplier may withhold the refund of the payment received until the goods have been collected or the buyer has provided proof that he has sent the goods back.
Important notice: Right of withdrawal does not apply to certain types of goodsas provided for by law. Food and other perishable products (especially those with a short shelf life) are exempt from the 14-day refund option. For this reason to buyers of food products from our offer (wild strawberries, food products) we cannot guarantee a refund for reasons of discretionif 14 days have passed since purchase or if the packaging has been opened. Food can only be returned as long as it is unused, unopened and in the same quantity, and only after by prior agreement with the provider. Please understand that these products are specific goods, where for hygiene and safety reasons no refund if the original packaging has been opened.
If you have received a damaged or faulty product, or if it is a clerical error the product (the product does not have the qualities promised by the supplier or the wrong/defective items have been sent), you have the right to claim the product - see below for the claim procedure. Please note that already used or partially used food products for hygiene reasons not eligible for reimbursement or replacement, unless it is a legitimate claim for defect or inadequacy.
Complaints and material defects
The tenderer is responsible for clerical errors the products sold, in accordance with the provisions of the Consumer Protection Act. Substantive error is given where the product does not have the characteristics necessary for its normal use or circulation, where the product does not have the characteristics which were expressly agreed or prescribed, or where the supplier delivers a product which does not correspond to a sample or model, unless the sample was shown only as a token.
The Buyer must notify us of any material defect within 2 months from the day he noticed the error. The notification should describe the defect in detail and include photographs or other evidence (if possible) to help us assess the validity of the complaint. A material defect or complaint form is available on request (you can write to us at our email address). The buyer must give us the opportunity to inspect the product. If the defect is not disputed, we will uphold the complaint within as soon as possible, but no later than 8 days from the date of receipt of the request or from the date of receipt of the returned product. If the fault is disputed, we will reply in writing within the same time limit.
Product complaint procedure: If you receive a damaged or faulty product, or if there is any discrepancy (e.g. the expiry date has passed, you have received the wrong product, the product is defective), please notify us as soon as possible - at the latest by 8 days from receipt of the consignment. You can notify your complaint in writing to our email address (attach a description of the problem and photos if the product is physically damaged). Upon agreement, we may also advise you to return the product at our expense or not to return it (depending on the type of product and the defect). For products delivered by the Post of Slovenia or GLS, in the case of damage during transport the buyer can also initiate the complaint procedure directly with the delivery service upon collection - in this case, the package should be returned to in the same condition as when you received itwithout adding or removing anything, and fill in the complaint slip at the post office. We will then work with the delivery service to resolve the complaint as quickly as possible.
In the event of a legitimate complaint (where it is confirmed that there is a defect in the product or other irregularity on the part of the supplier), we will, in agreement with you product replaced with a new seamless product or offer you refund of purchase price in full, including any shipping and return costs incurred by you. If the fault is with a product that is no longer in stock, we may refund your purchase price or, if agreed, send you another suitable product from our range.
The Supplier shall endeavour to resolve all complaints fast, efficient and for the benefit of the customer. Customer satisfaction means a lot to us, so if you have a problem, you will always be treated seriously and with a listening ear.
Protection of personal data
The protection of personal data in the context of our online shop is regulated in detail in Privacy Policy (see above). By entering into a contract (placing an order), the Customer agrees that the Provider may use the personal data provided by the Customer for the purposes of fulfilling the order and for communication in relation to the order. For other purposes, the provider will only use the personal data if it has a lawful basis for doing so or has obtained the buyer's explicit consent. The Provider undertakes to keep all personal data secure at all times in accordance with General Data Protection Regulation (GDPR) and the applicable Personal Data Protection Act. The Buyer has all the rights described in the Privacy Policy, including the right to inspect, correct, delete, etc., as provided by law.
Limitation of liability
The provider endeavours to ensure that the information on the website is up-to-date and correct. However, product characteristics, delivery times or prices can change so quickly that the supplier sometimes fails to correct the information on the website in time. In such a case, the Provider will inform the Customer of the changes and allow the Customer to cancel the order or exchange the ordered product. The photographs of the products on the website are symbolic; the actual appearance of the product may vary slightly (e.g. in colour shade, packaging). The Provider reserves the right to make minor changes to the content of the descriptions without prior notice.
The online shop operates 24 hours a day, every day of the year. The Provider reserves the right to temporarily disable access to the Online Shop for a short period of time for maintenance or technical reasons. We shall not be liable for any intermittent problems with the operation of the Site caused by technical or maintenance failures, but we will endeavour to rectify such failures as soon as possible. We are also not responsible for the content of product reviews written by visitors - although we do review reviews and remove offensive or inappropriate content before publication, we cannot be held responsible for the information provided by users in their product reviews.
Dispute resolution and legal protection
The Provider and the Purchaser will try to resolve any disputes amicably and by negotiation. If no amicable settlement is possible, the court with jurisdiction to settle disputes shall be the court with jurisdiction over the Buyer's domicile (if the Buyer is a natural person, a consumer) or, if the parties have not agreed otherwise, the court with jurisdiction in Slovenia with jurisdiction over the Provider's domicile shall have jurisdiction over the Buyer's domicile.
The General Terms and Conditions are drawn up in accordance with Consumer Protection Act (CPA) and Code of Obligations (CC) and take into account the recommendations of the Slovenian Chamber of Commerce. All issues not expressly covered by these Terms and Conditions shall be governed by the provisions of the applicable legislation of the Republic of Slovenia.
If any provision of these General Terms and Conditions is found to be invalid or unenforceable, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a legally permissible provision which is closest in meaning and intent to the original provision.
Changes to the Terms and Conditions
The Provider may update or amend these General Terms and Conditions in the future to comply with new legal provisions or to meet its own business needs. Any changes will be published on the AlpineBerryTale.com website; date of last update will be clearly stated. The Buyer is bound by the General Terms and Conditions that were in force (published on the website). at the time the order is placed. We recommend that you check the current terms and conditions from time to time when making repeat purchases to ensure that you are aware of any changes.
